The first three months of 2011 (January 1, 2011 to March 31, 2011) ended with 108 murders of women in the State of Chihuahua. 72 out of the 107 murders, which represent the 66% , took place in Ciudad Juárez, city that heads  the  list of the most dangerous places for women.

The social problem that represents the intentional homicide of women in Chihuahua State seems to be endless. The two NGO´s, Justice for Our Daughters (Justicia para Nuestras Hijas/JPNH) and the Center for Women's Human Rights (Centro de Derechos Humanos para las Mujeres /CEDEHM), that work together in the investigation and litigation of   feminicide cases, consider important to do a deep analysis about the proposal to amend Article 126 of the Chihuahua Penal Code,  which aim is to classify feminicide.

Since concepts like "gender violence" or "motives of hatred” contain an important grade of subjectivity, the initiative of feminicide classification could not warrant efficiently the punishment of these crimes. And if we add the prejudices and stereotypes of the operators of the justice system, this idea could represent a delay rather than a progress.

Lucha Castro, Coordinator of the Center for Women's Human Rights, said:  "This classification can help to show the problem, but the crime should not be just an image. The most important thing is the implementation of effective public policies to prevent feminicide effectively. "

In countries like Guatemala and El Salvador, the action of the feminicide classification has not reflected a decrease of the problem. Therefore what is needed is a serious proposal which must be supported by the law and to  include an integral  comprehension of feminicide.

In Chihuahua, we reserve the right to do a deep reflection and analysis on how and what would be the right way to classify feminicide. Unlike  other states in Mexico, Chihuahua is the only entity in the country that counts with the Decree 790 03 IX and Article 126 of the Penal Code, which provide an aggravated penalty in the murder of any woman, whether there are motives of hatred or not.

In other words, if the person who has been murdered is a woman, the criminal is going to obtain the greater penalty. Thanks to Article 126 of the Penal Code, the undersigned organizations have achieved maximum penalties for murderers of women, with just proving the crime and showing a birth certificate with the sex of the victim. The penalty for the murder of women in Chihuahua State runs from 30 to 60 years.

This legislative progress that has permitted the punishment of many feminicides in Chihuahua should be analyzed and use it as example in other states as part of the discussion on the definition of feminicide.
